Privacy policy

This Privacy Policy describes how Uthena LLC (“Uthena”, “we”, “us”, or “our”) collects, uses, and discloses your personal information when you visit, use our services, or make a purchase from uthena.com (the “Site”) or otherwise communicate with us regarding the Site (collectively, the “Services”). For purposes of this Privacy Policy, “you” and “your” means you as the user of the Services, whether you are a customer, instructor, affiliate, website visitor, or another individual whose information we have collected pursuant to this Privacy Policy.

Please read this Privacy Policy carefully.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Privacy Policy on the Site, update the “Last updated” date and take any other steps required by applicable law.

How we collect and use your personal information

To provide the Services, we collect personal information about you from a variety of sources, as set out below. The information that we collect and use varies depending on how you interact with us.

In addition to the specific uses set out below, we may use information we collect about you to communicate with you, provide or improve the Services, comply with any applicable legal obligations, enforce any applicable terms of service, and to protect or defend the Services, our rights, and the rights of our users or others.

What personal information we collect

The types of personal information we obtain about you depend on how you interact with our Site and use our Services. When we use the term “personal information”, we are referring to information that identifies, relates to, describes or can be associated with you. The following sections describe the categories and specific types of personal information we collect.

Information we collect directly from you

Information that you directly submit to us through our Services may include:

  • Contact details including your name and email address.
  • Order information including your name, billing address, company name and VAT or tax ID (both optional), email address, the products and licenses you bought and payment confirmation.
  • Account information including your email address, password (stored only as a secure hash) and other information used for account security purposes.
  • Course and license information including the courses you own, your license tier and license keys, your course progress and the files you download.
  • Customer support information including the information you choose to include in communications with us, for example, when sending a message through our contact form.
  • Newsletter information if you sign up for our emails: see Email marketing.
  • Instructor and affiliate information if you sign up as an instructor or affiliate: your public profile, the courses you upload, your payout email and the statement details you enter (legal name, company, address, country, VAT or tax ID), and your acceptance of the Instructor or Affiliate terms.

Some features of the Services may require you to directly provide us with certain information about yourself. You may elect not to provide this information, but doing so may prevent you from using or accessing these features.

Information we collect about your usage

We may also automatically collect certain information about your interaction with the Services (“Usage Data”). Usage Data may include information about how you access and use our Site and your account, including device information, browser information, information about your network connection, your IP address and other information regarding your interaction with the Services. Some Usage Data is collected with cookies; see the Cookie policy.

Information we obtain from third parties

We may obtain information about you from third parties, including from vendors and service providers who collect information on our behalf, such as:

  • Our payment processor, Stripe, which collects payment information (e.g., credit or debit card information, billing address) to process your payment in order to fulfill your orders and provide you with products or services you have requested, in order to perform our contract with you. We receive confirmation of the payment, not your full card details.
  • If you accept analytics cookies, Google Analytics, which gives us aggregated statistics about how the Site is used.
  • If you followed an affiliate’s or instructor’s referral link, or used their coupon code, the referral recorded by our affiliate software on our own server, so that we can credit them. This uses a necessary cookie for 30 days (see the Cookie policy); the legal basis is our legitimate interest, and our contracts with affiliates and instructors, in paying the commission they earned (Art. 6 (1) (b) and (f) GDPR).

Any information we obtain from third parties will be treated in accordance with this Privacy Policy. Also see the section below, Third-party websites and links.

How we use your personal information

  • Providing products and services. We use your personal information to provide you with the Services in order to perform our contract with you, including to process your payments, fulfill your orders, give you access to your courses, files and license keys, send you notifications related to your account, purchases and refunds, create, maintain and otherwise manage your account, issue invoices, and pay instructors and affiliates. The legal basis is the performance of our contract with you (Art. 6 (1) (b) GDPR) and, for invoices and bookkeeping, our legal obligations (Art. 6 (1) (c) GDPR).
  • Marketing. We send marketing emails only if you signed up for them (Art. 6 (1) (a) GDPR). You can unsubscribe at any time with the link in every marketing email. See Email marketing below.
  • Analytics. If you accept analytics cookies, we use Google Analytics 4 and WooCommerce order attribution to understand which pages and campaigns help people (Art. 6 (1) (a) GDPR). No name, email address or account ID is sent to Google, and advertising features are switched off.
  • Security and fraud prevention. We use your personal information to detect, investigate or take action regarding possible fraudulent, illegal or malicious activity, including the misuse of license keys. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password, or other access details with anyone else. If you believe your account has been compromised, please contact us immediately. If you are an EEA resident, the legal basis for these data processing activities is our legitimate interest in keeping our website secure for you and other customers, according to Art. 6 (1) (f) GDPR.
  • Communicating with you and service improvement. We use your personal information to provide you with customer support and improve our Services. This is in our legitimate interests in order to be responsive to you, to provide effective services to you, and to maintain our business relationship with you according to Art. 6 (1) (f) GDPR.

Email marketing

We send marketing emails only to people who asked for them. This is how our newsletter works:

  • What we send. Emails from Uthena about new courses and PLR products, deals and discounts, and tips for learning and for selling courses. We do not sell or rent our mailing list, and we do not send emails on behalf of other companies.
  • How you sign up. Only by your own choice: with the sign-up form on our website (for example the pop-up that some pages show), or by ticking the opt-in box at checkout, in your account or when you create an account. The box is never ticked for you, and buying something never signs you up.
  • Confirmation. When you sign up with the sign-up form, we first send you one email to confirm your address (double opt-in). You are only added to the list after you click the confirmation link. Sign-ups that are not confirmed are deleted after 30 days. When you tick the box in your own account or at checkout, that tick is your consent.
  • Unsubscribe at any time. Every marketing email contains an unsubscribe link, and you can also untick the box in your account or email us. Unsubscribing is free and takes effect straight away. We will still send you emails you need about your account and your orders.
  • What we store. Your email address, your account (if you have one), your subscription status, where and when you signed up, the exact consent text you agreed to, when you confirmed or unsubscribed, and a one-way hash of your IP address (to prevent abuse and to prove your consent; we do not store the IP address itself). With your consent we may also use your purchase history on Uthena to send you more relevant emails.
  • Where it is stored and who sends it. Your subscription is stored in our own database on our servers (Hetzner, European Union). Confirmation emails are delivered by SendGrid. We will send our newsletters with email marketing software that we run on our own servers; if we use another provider to store the list or deliver newsletters, we will name it in the Data processors list below before we use it.
  • How long we keep it. For as long as you are subscribed. When you unsubscribe, we keep only your email address and the date you unsubscribed, so that we never email you again by mistake. You can ask us to delete that record too.
  • Legal basis. Your consent (Art. 6 (1) (a) GDPR), which you can withdraw at any time without affecting the lawfulness of emails sent before you withdrew it.

Cookies

Like many websites, we use cookies on our Site. Necessary cookies keep you signed in, keep your cart, protect payments and credit the affiliate or instructor whose referral link you followed, and are always on. Analytics cookies (to see which pages and campaigns help people) and any marketing cookies are only set after you accept them in our cookie notice; until then the scripts that use them are not loaded. You can change your choice at any time with Cookie settings in the footer. The full list is in our Cookie policy.

Our website also recognizes the Global Privacy Control (GPC) signal. Because we do not sell or share personal information for targeted advertising, a GPC signal confirms the choice we already apply to everyone. Other than the Global Privacy Control, we do not recognize other “Do Not Track” signals that may be sent from your web browser or device.

How we disclose personal information

In certain circumstances, we may disclose your personal information to third parties for contract fulfillment purposes, legitimate purposes and other reasons subject to this Privacy Policy. Such circumstances may include:

  • With vendors or other third parties who perform services on our behalf (e.g., hosting, payment processing, video streaming, file storage, email delivery and analytics) — see Data processors below.
  • With the instructor whose course you buy: instructors see the sales and earnings of their own courses, not your payment details.
  • With an affiliate or instructor whose referral link you followed: they see that a referred order was placed and its amount, not your name or contact details.
  • When you direct, request us or otherwise consent to our disclosure of certain information to third parties.
  • In connection with a business transaction such as a merger or bankruptcy, to comply with any applicable legal obligations (including to respond to subpoenas, search warrants and similar requests), to enforce any applicable terms of service, and to protect or defend the Services, our rights, and the rights of our users or others.

We do not sell personal information, and we do not share it for cross-context behavioral advertising. See Your privacy choices.

We do not use or disclose sensitive personal information without your consent or for the purposes of inferring characteristics about you.

Data processors

To operate the Uthena platform we share specific categories of data with the following service providers. Each processes the data on our behalf under a data processing agreement.

  • Hetzner Online GmbH (Germany) — hosts this website, including its database and file system, in the European Union. Lawful basis: legitimate interest (operating the platform).
  • Stripe (Stripe Payments Europe Ltd.) — processes payments and billing details for course purchases. Lawful basis: contract.
  • Bunny.net (BunnyWay d.o.o.) — hosts and streams course videos through signed links; no personal information is placed in video links. Lawful basis: legitimate interest (course delivery).
  • BackBlaze (Backblaze, Inc.) — stores course files and PLR packages, delivered through short-lived signed download links, and our backups. Lawful basis: contract (file delivery).
  • SendGrid (Twilio Inc.) — delivers our transactional emails, such as order confirmations, password resets and license keys (lawful basis: contract), and the email that confirms a newsletter sign-up (lawful basis: consent).
  • Google Analytics 4 (Google Ireland Ltd.) — only if you accept analytics cookies; pseudonymous usage statistics. Lawful basis: consent.
  • PayPal — used to pay instructors and affiliates their earnings. Lawful basis: contract.
  • Payoneer (Payoneer Inc.) — used to pay some instructors and affiliates their earnings; we share the payee’s name, Payoneer email address and the amount. Lawful basis: contract.

Affiliate and instructor referrals and royalties are recorded with AffiliateWP, which runs on our own server; no data is sent to a third party for this.

Our Site may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on these sites. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms may also be viewable by other users of the Services and/or users of those third-party platforms without limitation as to its use by us or by a third party. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.

Children’s data

The Services are not intended to be used by children, and we do not knowingly collect any personal information about children. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details set out below to request that it be deleted.

As of the Effective Date of this Privacy Policy, we do not have actual knowledge that we “share” or “sell” (as those terms are defined in applicable law) personal information of individuals under 16 years of age.

Security and retention of your information

Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee “perfect security.” In addition, any information you send to us may not be secure while in transit. We recommend that you do not use insecure channels to communicate sensitive or confidential information to us.

How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, to provide the Services, comply with legal obligations, resolve disputes or enforce other applicable contracts and policies. In particular:

  • Your account data is kept while your account exists.
  • Orders, invoices, royalty and payout records are kept for 7 years, as tax law requires.
  • Download logs are kept for 90 days.
  • Newsletter subscriptions are kept while you are subscribed; unconfirmed sign-ups are deleted after 30 days; after you unsubscribe we keep only your email address and the unsubscribe date, so that we do not email you again.
  • If you delete your account, we delete or anonymize your personal information, except the records we must keep by law.

Your rights

Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. However, these rights are not absolute, may apply only in certain circumstances and, in certain cases, we may decline your request as permitted by law.

  • Right to access / know: You may have a right to request access to personal information that we hold about you, including details relating to the ways in which we use and share your information.

  • Right of portability: You may have a right to receive a copy of the personal information we hold about you and to request that we transfer it to a third party, in certain circumstances and with certain exceptions.
  • Right to opt out of sale or sharing or targeted advertising: You may have a right to direct us not to “sell” or “share” your personal information or to opt out of the processing of your personal information for purposes considered to be “targeted advertising”, as defined in applicable privacy laws. We do not sell or share personal information; see Your privacy choices.
  • Restriction of processing: You may have the right to ask us to stop or restrict our processing of personal information.
  • Withdrawal of consent: Where we rely on consent to process your personal information, you may have the right to withdraw this consent, for example with Cookie settings in the footer or the unsubscribe link in our emails.
  • Appeal: You may have a right to appeal our decision if we decline to process your request. You can do so by replying directly to our denial.
  • Managing communication preferences: We may send you promotional emails if you opted in, and you may opt out of receiving these at any time by using the unsubscribe option displayed in our emails to you. If you opt out, we may still send you non-promotional emails, such as those about your account or orders that you have made.

You may exercise any of these rights where indicated on our Site or by contacting us using the contact details provided below.

We will not discriminate against you for exercising any of these rights. We may need to collect information from you to verify your identity, such as your email address or account information, before providing a substantive response to the request. In accordance with applicable laws, you may designate an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us. We will respond to your request in a timely manner as required under applicable law.

Please note that we may transfer, store and process your personal information outside the country you live in. Your personal information is also processed by staff and third-party service providers and partners in these countries. Our website and database are hosted in the European Union.

If we transfer your personal information out of Europe, we will rely on recognized transfer mechanisms like the European Commission’s Standard Contractual Clauses, or any equivalent contracts issued by the relevant competent authority of the UK, as relevant, unless the data transfer is to a country that has been determined to provide an adequate level of protection.
